Acceptable Use Policy (AUP) policy describes the acceptable conduct
of customers and users of our services. The Policy is not exhaustive and we reserve
the right to modify it at any time. By using our service, you agree to abide by
the then current version of this AUP, as posted on the website.
ANY VIOLATION OF THIS POLICY MAY RESULT IN THE SUSPENSION OR TERMINATION OF OUR
SERVICE WITHOUT NOTICE AND ANY OTHER ACTION AS WE DEEM APPROPRIATE.
ANY REPEATED VIOLATION OF THIS POLICY WILL RESULT IN THE TERMINATION OF YOUR AGREEMENT
WITH US TO USE THE SERVICE.
INDIRECT OR ATTEMPTED VIOLATIONS OF THIS POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS
BY A THIRD PARTY ON YOUR BEHALF, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY
YOU.
Transfer It Online (TIO) supports the uncensored exchange of information and ideas
by means of the Internet and does not monitor the content of e-mail traffic.
Any omission by TIO, for any reason whatsoever, to monitor the strict observance
of this policy cannot in any way be considered as leave for undesirable behavior.
Customer’s Responsibility
Each TIO customer is responsible for his activities, the activities of his representatives
or end-users and, by accepting service from TIO, is agreeing to ensure that its
representatives or end-users abide by this AUP. He must take the necessary
precautions to prevent abuse of your account by any third party.
You as a customer are solely liable for any content you transfer using our service.
You agree to indemnify and hold us harmless from any claim, action, demand, loss,
or damage (including legal fees) made or incurred by any third-party arising out
of or relating to your violation of this UAP.
Your personal password and public/private key pair enables you to gain access to
your account. You need to take the necessary precautions to prevent unauthorized
access to your account by any third party. It is your responsibility to keep your
password secret.
No Illegal or Harmful Uses
Our Services may be used only for lawful purposes. The transmission and distribution
of any information in violation of any applicable law or regulation (foreign or
domestic) is strictly prohibited. TIO reserves the right to restrict or prohibit
any and all activities that it determines in its sole discretion may be harmful
to its systems, network, reputation, good will, other TIO customers, or any third
party. The following non-exhaustive list describes the kinds of illegal or harmful
conduct that are prohibited.
The term material in this context includes all forms of communication comprising
text, graphics (photographs, illustrations, images, drawings and logos), executable
files, video recordings, and/or audio recordings.
1. Transmission or distribution of any material in violation of any applicable law
or regulation is prohibited. This includes, without limitation, material protected
by copyright, trademark, trade secret, patent or other intellectual property right
used without proper authorization, unauthorized use, or forging, of mail header
information (e.g. "spoofing") and material that is obscene, defamatory,
constitutes an illegal threat, or violates laws.
2. Sending unsolicited mail messages, including the sending "junk mail"
or other advertising material to individuals who did not specifically request such
material ("e-mail spam"). This includes, but is not limited to, bulk-mailing
of commercial advertising, informational announcements, and political tracts. It
also includes posting the same or a similar message to one or more newsgroups (excessive
cross-posting or multiple-posting accounts or services may not be used to solicit
customers from, or collect replies to, messages sent from another Service Provider
where those messages violate this Policy or that of the other provider).
3. Disseminating or hosting harmful content including, without limitation, viruses,
Trojan horses, worms, time bombs, cancel bots or any other computer programming
routines that may damage, interfere with, surreptitiously intercept or expropriate
any system, program, data or personal information.
4. Offering or disseminating fraudulent goods, services, schemes, or promotions
(i.e., make money fast schemes, chain letters, and pyramid schemes); fraudulent
submission or use of personal or financial information; or engaging in any practice
that constitutes an unfair or deceptive trade practice; or to promote fraudulent
activities
5. Disseminating material that is libellous, defamatory, indecent, harassing, threatening,
harmful, invasive of privacy or publicity rights, abusive, inflammatory or otherwise
objectionable.
6. Unauthorized attempts by a user to gain access to any account or computer resource
not belonging to that user (e.g., "cracking"); as well as Unauthorized
access, alteration, destruction, or any attempt thereof, of any information of any
TIO customers or end-users by any means or device.
7. Adding, removing, or modifying network headers with intent to deceive or swindle.
You may not pose as another party by using forged headers or any other information
regarding a party’s identity. The use of anonymous re-mailers or nicknames
is expressly excluded from this prohibitory clause.
8. Obtaining or attempting to obtain service by any means or device with intent
to avoid payment.
9. Collecting personal details through the services provided by TIO, of any third
party without their knowledge and written consent.
10. Malicious intent to prevent another party from using electronic mail and/or
news services (E-mail or news bombing)
11. Knowingly engage in any activities that will cause a denial-of-service (e.g.,
synchronized number sequence attacks) to any TIO customers or end-users.
12. Excessive use or abuse of the TIO facilities b that adversely affect other customers.
Abuse and use of the network, CPU time, memory, disc space, and sessions in a manner
putting undue strain on the facilities are not permitted.
13. Using the services provided by TIO for any activity that prevents or disrupts
any third party’s capability of using the services offered by TIO and/or the
Internet. This includes Denial of Service (DoS) and Distributed Denial of Service
(DDoS) attacks, e-mail bombing and such.
14. Engaging in any action disrespecting the dignity of people, especially of persons
under the age of 18 years.
Non-Transferability of Account
The right to use TIO’s Internet service is not transferable. Use is expressly
limited to the individual or business whose name appears on the contract.
Cooperation with Authorities
TIO reserves the right to cooperate with law enforcement and other authorities in
investigating claims of illegal activity or other undesirable activities.
Confidentiality of Personal Subscriber Information
TIO will not release the Customer’s personal subscriber information, nor the
Customer’s billing information, to any third party except upon presentation
of a valid court order, or a request to which TIO is legally required to respond
to. Customers agree that TIO’s judgment as to the validity of any court
order, subpoena, or request shall be considered proper and final.
Enforcement
We reserve the right but do not assume the obligation to strictly enforce this Policy
without limitation, by issuing warnings, suspending or terminating Service,
We may cooperate with appropriate law enforcement agencies to assist in the investigation
and prosecution of any illegal conduct by providing network, systems, and transaction
information related to allegedly illegal, harmful or objectionable content.
Reporting infringements
Transfer It Online requests anyone who believes that an infringement of this AUP
has taken place to report this to our abuse department at abuse@transferitonline.com,
including as much as possible of the following information:
- the IP address from which the suspected infringement was committed;
- the date and time of the suspected infringement, including the time zone or GMT
(UTC) offset;
- proof of the suspected infringement.
Changes to this acceptable use policy
TIO reserves the right to modify this AUP at any time. If we make any material changes
to this Policy, we will post an "update" notice to our site and change
the date of the Policy. You should refer back to this page for the latest information.
All litigations will be submitted to the courts of Mechelen, Belgium.
